    The man also wanted a car, costs related to university study, the highest level of health cover and orthodontic treatment.

    Federal Magistrate Stuart Lindsay, sitting in Adelaide, was urged to find that the orders were necessary "because of a mental or physical disability of the child", as had been provided for under the Family Law Act.

    But he said a psychologist's report tendered to the court on behalf of the man offered him little support.

    "Against the legislative test, some of the orders sought … have a strong element of the far-fetched and impertinent about them," he said.

    Mr Lindsay described the application as "hopeless and bound to fail" and said it was "an unreasonable imposition to make upon the respondents".

    He said the man had waited 13 years after being recommended for gender reassignment surgery before bringing the legal action.

    Undeterred, the man lodged an appeal in the Family Court.

    In a judgement delivered in August, Family Court Justice Steven Strickland dismissed the appeal and ordered the man to pay costs.

  • rightly so, as much as its not her fault she is TG, u can hardly blame the parents. That’s a bit wacky. The only disturbing thing to me is this person is obviously way post op and been living as a female for a long time. I think (and I am not trying to be a PC Nazi) that she should be referred to as she regardless of the nature of her preposterous claims. Pronouns are pretty important to our mob as its a hard struggle and after dragging your hormonally fatigued body and mind through transition we tend to feel its only right that we be addressed appropriately. It always irks me that the media love to pick up on titillating, sensational TG stories and miss all the great stories of TG people who achieve success in the face of adversity. Where are these stories? We don’t know cause they don’t sell news. The mythology surrounding transsexuals is so skewed, miss understood and tiresome. The only people that seem to get attention are unstable types who mostly unknowingly or unwittingly find them selves representing the T community in the worst possible way. Like every other community or subculture we span all social demographs. Arrr some bodies gotta “drag” the line, right?

    a) that's how she'd prefer to be addressed; and
    b) at the original hearing, the applicant was listed as a Ms, and addressed by His Honour as such, suggesting that her legal gender is female.

    ^ based on common mythology, the truth is no one chooses this. Why would you choose? Its a given and you just gotta except that. Its like saying a polio sufferer chooses to be crippled. For the life of me I don't understand why people don't understand that fundamental point. You don't choose transsexualism the same way as you don't choose cancer or being born into money. Its just the way it is. Cant point the finger as there is nobody to blame, including the parents.

    the Dr analogy is very old, simplistic and redundant. It just illustrates the level of ignorance that still exists in a society that still feels threatened by gender diversity.

    It somehow seems to me as long as some people continue to "choose" (thats the only choice here) to see it as a choice it gives them credence to ridicule and disrespect. Unfortunately being on the other side of that isn't very much fun and just adds to the frustration of trying to live an honest and transparent life without discrimination.
